Public offer
This Public Offer, hereinafter referred to as the "Offer", is an official public offer to conclude a Contract for the sale of goods remotely, i.e. through an online store, hereinafter referred to as the "Agreement", and places the Public Offer (offer) on the official website of the Seller https://ilcammeo.ua/ hereinafter - "Internet Site".
1. Terms used in the contract
1.1. Public offer ("Offer") - a public offer of the Seller, addressed to an unspecified circle of persons who have legal capacity and all the necessary rights and powers to enter into and execute this Public Agreement, to conclude a Public Agreement for the sale of goods remotely with the Seller on the conditions that contain a real Offer.
1.2. An order for the purchase of Goods on the website of the online store – items specified by the Buyer from the range of Goods offered for sale when placing an order for the purchase of the Goods on the website of the online store.
1.3. Acceptance is the Buyer's giving full and unconditional consent to the Seller's offer to enter into a Public Contract on the terms stipulated in this Public Contract.
1.4. The product is a jewelry made of precious metals and gemstones/semi-precious stones, related products, in quantity, assortment and price, presented in the online store on the website ilcammeo.ua.
1.5. The online store is the official online store located at https://ilcammeo.ua.
2.Subject of the contract
2.1. Under the terms of this Public Contract, the Seller undertakes to transfer to the Buyer the Goods specified in the order placed by the Buyer, and the Buyer undertakes to accept the Goods and pay for them in the manner and under the conditions stipulated by this Public Contract.
3. Acceptance of the contract
3.1. For the Buyer, confirmation of full and unconditional acceptance of the Public Offer is the Buyer's order placed through the Find out the price and order confirmation button on the Seller's website at the web address ilcammeo.ua.
Both registered and unregistered users of the ilcammeo.ua website can order the Product.
3.2. From the moment the Seller receives the order for the purchase of the Goods, the Public Contract is considered concluded without further signing by the Parties.
4. Order registration procedure
4.1. If the Buyer decides to purchase jewelry, the order can be placed by the Buyer via the Get price button on the website.
4.2. The Seller undertakes to contact the Buyer by e-mail or telephone specified by the Buyer within one working day from the moment of placing the Application for the purchase of the Product to confirm the order. The seller agrees on additional characteristics, completeness, order price, terms of payment and delivery.
4.3. In case of complications or to obtain additional information, the Buyer contacts the Seller at the phone number indicated on the website:

4.4. The Seller is not responsible for the content and authenticity of the information provided by the Buyer when placing an order for the purchase of the Goods.
4.5. The buyer is responsible for the accuracy of the information provided when placing an order for the purchase of goods.
5. Price of the Product
5.1. The price for each item of the Product, indicated on the website of the online store at the time of ordering the Product, requires confirmation from the Seller after receiving the Buyer's order for the purchase of the Product.
5.2. The seller has the right to unilaterally change the price of any product item.
5.3. The Buyer's obligations to pay for the Goods are considered fulfilled from the moment of receipt and crediting to the Seller of 100% of the amount of funds for the ordered Goods.
6. Return of goods.
6.1. Jewelry products are not subject to exchange and return in accordance with the list of goods of proper quality that are not subject to exchange (return), approved by Resolution of the Cabinet of Ministers of Ukraine No. 172 dated 19.03.1994.
6.2. In case of discovery of significant defects (hidden defects), the Buyer has the right to submit to the Seller the requirements provided for in Article 8 of the Law of Ukraine "On the Protection of Consumer Rights".
7. Product quality. Product warranty period.
7.1. The quality of the Goods offered by the Seller through the online store meets the requirements and standards stipulated by the current legislation of Ukraine for this category of goods.
7.2. The seller provides a guarantee for the Goods for the period specified by the manufacturer of the Goods.
7.3. The Buyer's rights in cases of detection of defects in the purchased Goods are provided for by the current legislation of Ukraine.
7.4. Delivery to the Seller of the Goods, in which the Buyer has discovered defects, is carried out at the Buyer's expense.
8. Liability of the parties
8.1. The parties are responsible to each other for the fulfillment of their obligations. For non-fulfillment or improper fulfillment of obligations under this Agreement, the Parties bear the responsibility provided for by the current legislation of Ukraine.
8.2. If the Buyer violates the payment terms for the Goods, the Seller has the right to charge the Buyer a penalty in the amount of double the NBU accounting rate effective at the time of the delay for each day of the delay, as well as postpone the delivery date of the ordered Goods until the time the Buyer pays for the Goods.
8.3. Payment of the penalty does not release the Buyer from the fulfillment of obligations under this Public Contract.
8.4. All disputes and disagreements of the parties that arise during the execution of this contract shall be resolved through negotiations, if the parties are unable to reach an agreement, such disputes shall be resolved in a court of law in accordance with the current legislation of Ukraine.
8.5. Neither party shall be liable for the full or partial failure to perform any of its obligations if the failure to perform is the result of force majeure circumstances, such as natural disasters, extreme weather conditions, fires, military operations, that occurred after the conclusion of this agreement.
8.6. If any of the listed circumstances directly affected the fulfillment of the obligation within the term established by this agreement, this term will be postponed in proportion to the effect of the relevant circumstance.
9. Term of validity of the public contract
9.1. The Public Agreement enters into force from the moment of its acceptance by the Buyer and is valid until the Parties fully fulfill their obligations stipulated by this Public Agreement.
9.2. The public agreement may be prematurely terminated by mutual consent of the Parties.
9.3. The Public Contract may be terminated by the Seller in case of breach by the Buyer of its obligations under this Public Contract.
10. Other conditions
10.1. The Seller has the right to make changes to the Public Contract without notifying the Buyer, which take effect from the moment the Seller makes changes by posting them on the ilcammeo.ua website.
10.2. The Buyer, while on the Seller's website, gives his consent to the Seller for the use and processing of his personal data exclusively for the exercise of powers and actions necessary for the realization of his rights and obligations provided for in this contract, and the transfer of personal data about the Buyer to a third party exclusively in accordance with Law of Ukraine "On Personal Data Protection". The buyer confirms that he/she is familiar with the rights enshrined in the Law of Ukraine "On the Protection of Personal Data".
10.3. The public contract is concluded by joining the Buyer to the Contract proposed by the Seller in full and accepting all the essential terms of the Contract without signing a written copy and has legal force in accordance with the provisions of Art. 633, 634 of the Civil Code of Ukraine. The buyer cannot offer the terms of the Public Contract.
10.4. The Buyer allows the Seller to record and store telephone calls, correspondence, messages, including electronic ones, related to the execution of the Buyer's Order for the purchase of Goods and obligations under this Agreement.
10.5. The seller does not guarantee the absolute uninterrupted or error-free operation of the online store at ilcammeo.ua and undertakes to take all efforts and measures to prevent this from happening and to eliminate the problems that have arisen.
